Term of sales

ARTICLE 1 – GENERAL

The buyer acknowledges having read these Terms and Conditions of Sale (T&Cs) before placing the order. These T&Cs apply exclusively to all sales concluded for our products, owned by the company, both on its own behalf and on behalf of its agents. Any other conditions will only bind the seller upon prior written confirmation. Simply placing an order or accepting an offer from the seller constitutes unconditional acceptance of these T&Cs. Any terms formulated by the buyer that do not comply with our T&Cs will be rejected unless expressly and in writing acknowledged as applicable by us. These T&Cs may be amended at any time and without notice by the company Condom4Drink, with changes applying to all subsequent orders.

ARTICLE 2 – ORDERS

Orders are effective from the date payment is received. The client may request a refund under the conditions outlined in Article L 121-20-1. Condom4Drink commits to delivering the buyer as quickly as possible. The buyer will be delivered according to the deadlines mentioned on the website, except in exceptional cases (postal strikes, extraordinary events, etc.). However, delivery times may be extended (e.g., during certain times of the year, such as the Christmas period), which the buyer understands and accepts.

ARTICLE 3 – PRICES

The seller’s price list does not constitute a sale. Prices may be modified unilaterally without prior notice before the client’s purchase. Goods are billed at the agreed price within the option period and general economic conditions (taxes, exchange rates, etc.) at the time of delivery. All prices displayed on the seller’s website are quoted in euros, inclusive of all taxes, excluding shipping fees, which will be indicated before the buyer confirms the order. Prices may be subject to promotions, sales, and other discounts.

ARTICLE 4 – PAYMENT

All orders must be paid in euros. Payment in full must be made when the buyer places the order. At no point can amounts paid be considered as deposits or advance payments. To complete the order, the buyer must have a credit card or a PayPal account. Payment by card or PayPal is fully secured through Secret Socket Layer (SSL) protocol. Encryption ensures that no one can access the data for malicious purposes. The order will be shipped upon receipt of payment. The buyer guarantees Condom4Drink that they hold any necessary authorizations to use the chosen payment method when placing the order. Condom4Drink reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and stage of execution, in case of non-payment or payment issues. Condom4Drink may request a photocopy of the buyer’s ID and/or proof of address for any order. To combat internet fraud, your order details may be verified.

ARTICLE 5 – PRODUCT SELECTION

Having reviewed the products and their features marketed by Condom4Drink, the buyer is solely responsible for choosing the products that meet their needs, as determined before placing the order. In case of unavailability, and without contradicting the provisions of Article 2, Condom4Drink may provide a product or service of equivalent quality and price.

ARTICLE 6 – WARRANTY

All products sold by Condom4Drink are subject to warranty. This warranty applies only to products sold by Condom4Drink and is effective from delivery, not from product use. Warranty durations are specified on the product sheets on the website.

Exclusions from warranty:

Intentional damage inflicted on the product
Misuse, contrary to recommendations or the user manual
Non-compliance with safety instructions
Cosmetic damage
In the event of delivery with damaged products, Condom4Drink commits to either refunding the client or resending the product.

ARTICLE 7 – DELIVERY

Delivery timeframe: All products are stocked in our warehouse in France (we are not “dropshippers”; we own and manage our brand and supply chain). Your order will be dispatched within a maximum of 3 business days (excluding incidents) from our logistics center unless stated otherwise on the product page or during checkout. Once dispatched, you will receive a tracking number from our provider (Colissimo or DPD) to locate your package. Delivery usually takes 48–72 business hours.

General rules: Products will be delivered to the address specified by the buyer on the order form. In case of absence, a delivery notice will be left in your mailbox, allowing you to reschedule delivery or collect the products from a designated location within the timeframe specified by the carrier on the notice.

Delivery issues: The buyer is required to inspect the packaging, contents, and operation of the goods upon delivery in the presence of the delivery agent. If there is any doubt, the buyer must: Follow the return procedure (e.g., report damages, claims, or reservations) and refuse the goods by immediately issuing an anomaly report to the delivery agent. Incidents must be reported within 3 days of the buyer’s refusal of the goods, clearly stating the claims or reservations.

Quality or conformity issues: If a product delivered does not match the order (defective or non-compliant), the buyer must file a claim within 5 days of signing the delivery note. Claims must be submitted via the contact form and include: The buyer’s contact details, the relevant order number, product references, and reasons for the claim. The return procedure will then be communicated. Returned products must be sent back by the buyer within 15 business days of delivery or the return authorization date.

ARTICLE 8 – RETENTION OF TITLE

In accordance with the law, ownership of goods delivered to the buyer will only transfer after full payment of the principal and accessory price or after clearance of accepted checks or other means of payment issued for price settlement. During the period between delivery and transfer of ownership, the buyer bears the risks of loss, theft, or destruction. Non-compliance with payment obligations by the buyer, for any reason, gives the seller the right to demand the immediate return of delivered goods at the buyer’s expense, risk, and peril.

ARTICLE 9 – RIGHT OF WITHDRAWAL & RETURNS

Right of withdrawal:
French buyers have a legal right to withdraw from a purchase within 14 days from the day after taking possession of the product. Return shipping costs will be borne by the buyer. This right of withdrawal also applies to discounted products. Refunds will be issued within 14 days after Condom4Drink receives the returned product. The buyer must notify Condom4Drink in advance of their withdrawal decision via the contact form. Condom4Drink will inspect the returned product to validate its condition.

Returns:
Refer to the warranty exclusions outlined in Article 6. The buyer must return the product in its original packaging, unused, with all accessories, and indicate the reason on the invoice.

The buyer may choose from the following options:

• A replacement delivery matching the order
• Repair of the defective product
• Exchange of the product for a similar item
• Order cancellation
